1) Acceptance of Terms

Welcome to Sirkup AI ("we," "our," or "the Service"). By accessing or using our AI image generation platform, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you and Sirkup AI. Your use of the Service confirms your acceptance of these Terms and our Privacy Policy, which is incorporated by reference.

2) Service Description

Sirkup AI provides an AI-powered image generation platform that allows users to create, edit, and refine images using artificial intelligence and machine learning models. Our Service includes:

• Text-to-image generation using AI models
• Image editing and refinement capabilities
• Personal gallery for storing generated images
• Feedback and rating system for generated content

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3) User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years old to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4) Content & Ownership

Your Content: You retain ownership of any prompts, inputs, or original creative direction you provide to the Service ("User Input"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Input solely to provide and improve the Service.

Generated Images: Images generated by our AI models ("Generated Content") are jointly owned by you and Sirkup AI. You may use Generated Content for personal and commercial purposes, subject to these Terms. We reserve the right to use Generated Content (anonymized and de-identified) to improve our models and services.

Prohibited Content: You may not use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

5) Acceptable Use Policy

You agree NOT to use the Service to:

• Generate images depicting illegal activities, violence, or harm to individuals
• Create deepfakes, non-consensual intimate images, or impersonate others
• Violate any intellectual property rights, including copyrights and trademarks
• Generate spam, malware, or any malicious content
• Attempt to reverse engineer, decompile, or extract our AI models
• Bypass any rate limiting, security measures, or access controls
• Scrape, harvest, or collect user data without authorization
• Use the Service in any way that violates applicable laws or regulations

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action.

6) Intellectual Property Rights

The Service, including its software, design, text, graphics, logos, and underlying technology, is owned by Sirkup AI and protected by copyright, trademark, and other intellectual property laws.

Our AI models and algorithms are proprietary and confidential. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.

7) Payment & Subscriptions

Certain features of the Service may require payment. If you subscribe to a paid plan:

• You authorize us to charge your payment method for all fees incurred
• Subscription fees are billed in advance on a recurring basis
• All fees are non-refundable unless otherwise required by law
• We may change our pricing with 30 days' notice to active subscribers
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period

We use third-party payment processors and are not responsible for errors or issues arising from their services.

8) Service Availability & Modifications

We strive to provide reliable and continuous access to the Service, but we do not guarantee that the Service will be available at all times or free from interruptions, errors, or bugs.

We reserve the right to:

• Modify or discontinue any feature or aspect of the Service
• Perform scheduled or emergency maintenance
• Implement rate limits or usage caps
• Update our AI models and algorithms

We will make reasonable efforts to notify users of significant changes, but we are not obligated to do so.

9) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or quality of Generated Content
• Non-infringement of third-party rights
• Uninterrupted, secure, or error-free operation

AI-generated content may contain errors, biases, or inaccuracies. You are solely responsible for reviewing and verifying all Generated Content before use.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIRKUP AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes but is not limited to:

• Loss of profits, revenue, data, or business opportunities
• Service interruptions or errors
• Unauthorized access to your account or content
• Errors or inaccuracies in Generated Content
• Any third-party conduct or content

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11) Indemnification

You agree to indemnify, defend, and hold harmless Sirkup AI and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights, including intellectual property rights
• Any User Input or Generated Content you create or distribute

12) Termination

You may terminate your account at any time by using the account deletion feature in your profile settings. Upon termination, your access to the Service will cease immediately.

We may suspend or terminate your account at any time for any reason, including:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent or illegal activity
• Extended periods of inactivity
• Request by law enforcement or government agencies

Upon termination, we may delete your account data, including Generated Content, in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.

13) Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at legal@sirkup.ai and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English and held in [Jurisdiction].

Class Action Waiver: You agree to resolve disputes with us only on an individual basis and not as part of any class or representative action.

Exceptions: Either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorized access to the Service.

14) Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you by:

• Posting the updated Terms with a new "Effective date"
• Sending an email to your registered email address
• Displaying a prominent notice on the Service
